Terms of Service

1. Scope

These Terms of Service apply to the use of the web application Parabini, operated by Tobias Scheidt, Rauschener Ring 24a, 22047 Hamburg, Germany (hereinafter “Provider”). By registering, the user accepts these Terms of Service.

2. Description of Service

Parabini is an AI-powered web application for writing stories and books. The service includes the creation and management of books, chapters, and characters, as well as the use of AI features for text and image generation.

3. Registration and User Account

Full use of the service requires registration. The user is obligated to provide truthful information and to keep their access credentials confidential. The user is responsible for all activities under their account.

4. Intellectual Property – User Content

4.1 User Ownership

All texts, ideas, characters, plots, and other content that the user enters or creates in Parabini remain exclusively their intellectual property. Parabini makes no ownership claims to this content.

4.2 AI-Generated Content

Texts and images generated using Parabini's AI features based on the user's input are also considered the user's property, as they are based on their creative specifications (prompts, context, plot structure, character descriptions). The user bears responsibility for ensuring that this content does not infringe on third-party rights.

4.3 License to Parabini

The user grants Parabini a limited, non-exclusive, worldwide, royalty-free license to process and store their content solely for the purpose of providing and improving the service. This license terminates upon deletion of the account or the respective content.

4.4 No Use for AI Training

Parabini does not use user content for training AI models unless the user explicitly and separately consents to this.

4.5 Confidentiality

Parabini treats unpublished manuscripts and drafts as confidential and does not share them with third parties, except where technically necessary for service delivery (e.g., API calls to AI services).

4.6 Commercial Use

The user may freely use all content created in Parabini – including AI-generated texts and images – for commercial purposes, in particular publishing, selling, and marketing books. Parabini does not claim any revenue or participation from the commercial exploitation of such content.

4.7 Copyright Protection Notice

The user is advised that purely AI-generated content may not enjoy full copyright protection under current legislation in many countries (including the US and EU). Copyright protection generally requires substantial human creative contribution. Parabini therefore recommends using AI-generated texts as a foundation and shaping them into an original work through personal creative editing (revision, additions, selection, and arrangement).

4.8 Non-Exclusivity of Outputs

AI models may generate similar or, in rare cases, identical text passages or images for different users. Parabini therefore cannot guarantee exclusivity of AI-generated outputs.

5. AI Services and Third Parties

Parabini uses third-party AI services for text and image generation. For text generation, various providers may be used depending on user configuration: Anthropic (Claude), OpenAI (ChatGPT), Google (Gemini), xAI (Grok), and the open-weight model Gemma. For image generation, OpenAI (GPT Image), Google (Gemini Image), and xAI (Grok Imagine) are used. When using these services, user inputs required for generation are transmitted to the respective provider.

Parabini exclusively uses API access where, according to the respective provider's terms of service, transmitted data is not used for AI model training by default. For text generation via Anthropic, additional protection is provided through Anthropic's copyright indemnification for API customers.

6. Liability

The Provider is not liable for the accuracy or completeness of AI-generated texts. The user is responsible for reviewing and using all generated content. The Provider is not liable for damages arising from the use of AI-generated content, unless caused by intent or gross negligence on the part of the Provider.

7. Termination and Deletion

The user can schedule their account for deletion at any time in the account settings. After a 30-day period, all data will be permanently deleted. The Provider reserves the right to suspend or delete accounts in case of violation of these Terms of Service.

8. Changes to the Terms

The Provider reserves the right to modify these Terms of Service at any time. Users will be notified of changes. Continued use of the service after notification constitutes acceptance of the modified Terms of Service.

9. Final Provisions

The laws of the Federal Republic of Germany apply. The place of jurisdiction is Hamburg, insofar as legally permissible. Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected.
